Probate With a Will
If the decedent had a will, someone was named as executor of the will. The executor serves as personal representative of the estate. He or she is responsible for handling the final affairs of the estate during probate.
Probate Without a Will
If the decedent did not have a will, you may need to ask the probate court for a dependent administration. As a dependent administrator, you must petition the probate court to approve any of the tasks you undertake during the probate process, including the above-mentioned tasks.
